These Terms of Use (“Terms”) govern your access to and use of the ARTIX Funnel Creator website, application, and all related services (collectively, the “Service”) operated by ARTIX(a proprietary company owned by Gujjari Benjamin Vishal Anand; LIN: AP-06-18-006-03857412; UDYAM: UDYAM-AP-20-0064064) (“Company”, “we”, “our”, “us”), based in Vijayawada, Andhra Pradesh, India.

By accessing or using the Service — including browsing the website, creating an account, or using any feature — you agree to be legally bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

• You must be at least 13 years of age to create an account or use the free tier of the Service.
• You must be at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is greater) to make any purchase — including subscriptions and Credit Packs — through the Service.
• If you are between 13 and 18, a parent or legal guardian must complete any purchases and agree to these Terms on your behalf. By proceeding, you represent that your parent or guardian has done so.
• By using the Service, you represent and warrant that you have the legal capacity to enter into a binding agreement and that all information you provide is accurate and current.

2. Accounts & Registration

• OTP Authentication: The Service uses email-based One-Time Password (OTP) authentication. You are responsible for maintaining access to the email address associated with your account.
• Account Security: You are responsible for all activity that occurs under your account. If you suspect unauthorised access, notify us immediately at info@artix.co.in.
• One Account Per Person: You may not create multiple accounts to circumvent credit limits, free tier restrictions, or any other Service limitations.
• Accurate Information: You agree to provide truthful and accurate information about yourself and your business during onboarding and at all times thereafter.
• Account Transfer: You may not assign, transfer, or sublicense your account to any third party without our prior written consent.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the Service.

You specifically agree not to:

• Use the Service to generate content that is illegal, harmful, defamatory, obscene, hateful, harassing, threatening, or that violates any applicable law or regulation.
• Attempt to reverse-engineer, decompile, disassemble, or extract the source code or underlying algorithms of the Service.
• Scrape, crawl, spider, or systematically extract data from the Service using automated tools without our express written permission.
• Circumvent, disable, or interfere with security-related features of the Service, including rate limits, authentication systems, or credit controls.
• Use the Service to develop a competing product or service, or to benchmark the Service for competitive intelligence purposes.
• Introduce any viruses, trojans, worms, or other malicious or technologically harmful material into the Service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure or interfere with any other party's use of the Service.
• Resell, redistribute, or white-label the Service or its outputs without our explicit written consent.

4. User Content & AI-Generated Outputs

4.1 Your Content

“User Content” means all information, text, data, and prompts you submit to the Service (your business profile, input prompts for AI generation, etc.). You retain ownership of your User Content.

By submitting User Content, you grant ARTIX a limited, non-exclusive, worldwide, royalty-free licence to process, store, and display your User Content solely as necessary to provide the Service to you. This licence terminates when you delete the content or your account.

4.2 AI-Generated Outputs

Outputs generated by the Service (brand intelligence reports, audit narratives, SEO rewrites, playbook tasks, etc.) are produced using third-party AI APIs. While we design prompts to deliver accurate and useful results:

• AI outputs are provided for informational purposes only and do not constitute professional business, legal, financial, or marketing advice.
• AI outputs may contain inaccuracies, hallucinations, or errors. You are solely responsible for verifying and acting on any AI-generated information.
• ARTIX does not guarantee the accuracy, completeness, reliability, or commercial viability of AI-generated outputs.
• Ownership of AI-generated outputs is subject to the applicable AI provider's terms. We make no representation that AI outputs are copyrightable by you under applicable law.

4.3 Prohibited Content

You must not use the Service to create, generate, or store:

• Content that violates any applicable law or regulation in India or your jurisdiction.
• Content that infringes the intellectual property rights, privacy rights, or other rights of any person.
• Sexually explicit, obscene, or adult content.
• Content promoting violence, terrorism, self-harm, or hate speech based on protected characteristics (race, religion, gender, sexual orientation, disability, etc.).
• Spam, phishing content, or deceptive marketing materials designed to mislead consumers.

We reserve the right to remove any prohibited content and/or suspend your account without notice or refund.

5. Intellectual Property

• Our IP: The Service and its original content (excluding User Content and AI-generated outputs), features, design, code, trademarks, and branding are and remain the exclusive property of ARTIX and are protected by Indian and international intellectual property laws.
• Feedback: If you submit suggestions, ideas, or feedback about the Service, you grant ARTIX a perpetual, irrevocable, royalty-free licence to use and incorporate such feedback without obligation or compensation to you.
• No Implied Licence: Nothing in these Terms grants you any right, title, or interest in the Service or our intellectual property beyond the limited right to use the Service as described herein.

6. Third-Party Services & Links

The Service integrates with or links to third-party services (Razorpay, Google, HuggingFace, Groq, OpenRouter, Sentry, etc.). These third-party services have their own terms of service and privacy policies that govern their use. We are not responsible for the content, privacy practices, or reliability of any third-party service. Your use of third-party services is at your own risk.

7. Service Availability & Modifications

• We provide the Service on an “as-is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, error-free, or free of security vulnerabilities at all times.
• We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice, for any reason including maintenance, infrastructure upgrades, or business decisions.
• We may update these Terms of Use at any time. Material changes will be communicated via the email associated with your account and/or by updating the “Last Updated” date. Continued use after changes constitutes acceptance.
• We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

8. Termination

• By You: You may stop using the Service and request account deletion at any time by contacting us at info@artix.co.in or via the Settings page. Unused credits and prepaid subscription periods are non-refundable upon voluntary termination.
• By Us: We may suspend or permanently terminate your account immediately, without notice or refund, if you: (a) violate these Terms; (b) engage in fraudulent, abusive, or illegal activity; (c) cause harm to other users or the integrity of the Service.
• Effect of Termination: Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including §5, §9, §10, §11) shall survive.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated content.

ARTIX does not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) the results obtained from using the Service (including AI outputs) will be accurate, reliable, or suitable for any purpose; or (d) any errors in the Service will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall ARTIX, its directors, employees, agents, suppliers, or licensors be liable for any:

• Indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, or business opportunities.
• Damages arising from your reliance on AI-generated content, recommendations, or playbooks.
• Damages arising from unauthorised access to or alteration of your data.
• Damages arising from third-party services (Razorpay, AI providers, etc.) that are beyond our control.

Our total aggregate liability to you for any claims arising out of or relating to the Service shall not exceed the greater of: (a) the amount you paid to ARTIX in the 12 months preceding the claim, or (b) ₹1,000 (Indian Rupees One Thousand).

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Andhra Pradesh, India, without regard to conflict of law principles.

Built for India: This platform is built exclusively for businesses in India (specifically Vijayawada, Visakhapatnam, Guntur, Tirupati, Kakinada, Nellore, Rajahmundry, and towns across AP). People outside India may access the platform, but we do not adhere to, nor do we have compliance for, foreign laws (e.g. GDPR, CCPA). We are not responsible in any way for foreign usage or foreign compliance.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably through good-faith negotiation. If the dispute is not resolved within 30 days, it shall be subject to the exclusive jurisdiction of the courts located in Vijayawada and Visakhapatnam, Andhra Pradesh, India.
